Financial Responsibility:
The Owner agrees to pay all costs and expenses associated with veterinary treatment, diagnostics, medications, and transportation directly to the medical provider or reimburse the Service Provider immediately upon invoice.
4. Off-Leash Permission, Dog Parks & Escape Protocols
Equipment Integrity & Harness Slip-Outs: The Owner is responsible for providing well-fitting, secure, and properly maintained collars, harnesses, and leashes. The Service Provider's staff will visually inspect this equipment before each outing. Provided reasonable care in this inspection and in maintaining possession of the leash or handle, the Service Provider is not liable for a pet slipping out of or escaping from its collar, harness, or secondary equipment due to a defect or improper fit that was not reasonably apparent upon inspection.
Dog Park & Off-Leash Area Release: If the Owner grants written permission (see Section 9) for the pet to be taken to a public dog park, off-leash area, or enclosed space (such as a gated field or park court), the Owner acknowledges that off-leash activities carry inherent unpredictability and risk, regardless of whether an additional fee is charged. The Owner’s permission and acknowledgment of these risks apply to all such activities, including those offered as part of the Service Provider’s services.
The Service Provider agrees to maintain active supervision at all times; however, accidents, dog-on-dog altercations, injuries, or sudden escapes can occur in seconds despite reasonable care.
The Service Provider is not responsible or liable, including for its own ordinary negligence, for any injuries sustained by the pet, injuries inflicted on third parties or other animals, or instances where the pet squeezes through/under gates, jumps fences, or runs away while in an off-leash or dog park setting, except in cases of the Service Provider's gross negligence, recklessness, or intentional misconduct.
Off-leash privileges are granted solely at the Owner's risk.
ID Tags, Microchips & Tracking Devices: The Owner agrees to ensure that all pets are fitted with an ID tag displaying up-to-date contact information and are microchipped with current registry details prior to service. The Service Provider strongly recommends equipping pets with an active GPS tracking collar or device (e.g., Apple AirTag, Fi Collar, or Whistle). The Owner remains responsible for maintaining device batteries and active subscriptions.
Escape Protocol & Search Obligations: In the event that a pet escapes, the Service Provider will immediately initiate standard search and recovery protocols, including notifying the Owner, local animal control, and emergency contacts. The Service Provider’s active search commitment is limited to 48 hours from the time of escape, or up to the conclusion of the scheduled service window, whichever comes first. Following this period, primary search efforts and coordination transfer to the Owner and designated emergency contact. This time limit governs the duration of the Service Provider's search commitment only; it does not limit the Service Provider's liability, if any, for the escape itself where the escape resulted from the Service Provider's negligence. Except where the escape resulted from the Service Provider's gross negligence, recklessness, or intentional misconduct, the Service Provider shall not be liable for incidental damages, indirect losses, or emotional distress resulting from an escaped pet.
5. Pet Behavior, Mandatory Pickup & Additional Fees
The Service Provider reserves the right to determine, at its sole discretion and based on its professional judgment and standards, whether a pet is suitable for the services being provided. If a pet does not adjust well, exhibits behavior that raises concerns, or otherwise fails to meet the Service Provider’s standards, the Owner may be required to arrange pickup of the pet.
Mandatory Pickup: The Owner or their designated Emergency Contact must pick up the pet within four (4) hours of notification.
Additional Fees: If the pet is not picked up within the required timeframe, a fee of $75.00 per additional night may be charged to cover additional care, supervision, or other related expenses.
Alternative Placement: If necessary for the pet’s safety or the well-being of others, the Service Provider reserves the right to arrange alternative care. All reasonable transportation and third-party care expenses will be the Owner’s responsibility.
Abandonment: If the Service Provider is unable to reach the Owner or any designated Emergency Contact for a period of seven (7) consecutive days despite reasonable attempts to do so, the pet may be deemed abandoned. In that event, the Owner authorizes the Service Provider to transfer the pet to a licensed animal shelter or rescue organization in accordance with applicable law, and the Owner remains responsible for all boarding, veterinary, and related costs incurred up to the date of transfer.
6. Property Access & Third-Party Security (For In-Home Visits or Walks)

6. Property Access & Third-Party Security (For In-Home Visits or Walks)
Access: The Owner authorizes the Service Provider to enter the specified premises to perform agreed-upon pet care services during the requested service window. The Owner will provide the Service Provider with the keys, fobs, codes, or other access devices reasonably necessary to perform the services. The Service Provider will label all access devices without identifying the Owner's name or address, store them securely, and not disclose the Owner's address or access information to any unauthorized person. Upon request from the Owner, the Service Provider will return all physical access devices to the Owner and deactivate or delete any electronic access codes provided for the engagement, within a reasonable time not to exceed fourteen (14) days unless the parties agree otherwise for an ongoing engagement.
Unattended Home / Third Parties: The Service Provider is not responsible for any damage to the home or property caused by the pet, or, absent the Service Provider's own negligence, for unauthorized access or incidents occurring while other individuals (e.g., cleaners, contractors, family members) have access to the home during the service period.
7. Assumption of Risk & Liability Limitations
Inherent Risks: The Owner understands and acknowledges that working with animals carries inherent risks, including but not limited to accidental injury, sickness, unexpected behavioral reactions, escape, or property damage.
Pre-existing Conditions: The Owner has disclosed all known health conditions in Section 1. The Service Provider is not liable for health issues, injuries, or illness resulting from pre-existing conditions, age, or medical conditions not disclosed by the Owner in Section 1 or otherwise in writing prior to the applicable service date.
Liability Release: To the fullest extent permitted by law, the Owner agrees to release, indemnify, and hold harmless The Pet Getaway, its owners, operators, and staff from any and all claims, losses, damages, or expenses arising from the provision of pet care services, including those arising from the ordinary negligence of The Pet Getaway, its owners, operators, staff, employees, contractors, or agents, except in cases of proven gross negligence, recklessness, or intentional misconduct. Nothing in this Section eliminates or limits any liability that cannot legally be waived under New York law.
8. Dog-to-Dog Interactions and Responsibility
I understand that dogs may interact with other dogs during daycare, boarding, and other services provided by The Pet Getaway. These interactions involve inherent risks, including bites, scratches, fights, and other injuries, even when reasonable precautions are taken.
I agree to disclose any known history of aggression, biting, reactivity, resource guarding, or other behavioral concerns involving the dog in my care in Section 1 before services begin, and to promptly update the Service Provider in writing if any such history arises or becomes known after services begin.
I understand that under New York law, the owner of a dog that injures another dog or person may be held responsible for resulting veterinary expenses, damages, or other costs if that owner knew or reasonably should have known of the dog's aggressive or dangerous tendencies. Likewise, if the dog entrusted to The Pet Getaway is injured by another dog, responsibility for veterinary expenses and related damages will be determined based on the circumstances of the incident and applicable law. The Pet Getaway's staff are expected to exercise reasonable care in supervising, introducing, and separating dogs in their care.
I acknowledge that The Pet Getaway cannot guarantee that dog-to-dog incidents will never occur. Nothing in this provision eliminates or limits any liability that cannot legally be waived under New York law.
9. Additional Terms
Cancellation & Refund Policy: Cancellations made at least 24 hours before a scheduled visit or the start of a service will be fully refunded or credited. Cancellations made less than 24 hours in advance, or same-day cancellations, may be charged in full at the Service Provider's discretion.
Photo & Media Release: The Owner grants the Service Provider permission to photograph or video the Owner's pet(s) during services and to use such images on the Service Provider's website, social media, and marketing materials, unless the Owner opts out in writing by checking the box in Section 9.
Confidentiality: The Service Provider will keep the Owner's personal information, address, and access information confidential and will not disclose it to any unauthorized third party, except as necessary to provide the services or as required by law.
Entire Agreement: This Agreement, including any signed addenda, constitutes the entire agreement between the parties regarding the services described herein and supersedes all prior or contemporaneous oral or written understandings.
Severability: If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Governing Law & Venue: This Agreement shall be governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising under this Agreement shall be brought exclusively in the state or federal courts located in Kings County, New York.
10. Client Acknowledgment & Signatures
By signing below, the Owner acknowledges that they have read, understood, and agreed to all terms, health requirements, emergency authorizations, behavior policies, and liability waivers outlined in this agreement. The Owner specifically acknowledges and agrees that this Agreement releases The Pet Getaway from liability for its own ordinary negligence, as described in Sections 4, 6, 7, and 8, and not only for claims arising without anyone's fault.
